These Terms of Use ("Terms") govern your use of Moply Cleaning services and website. By booking our services or using our website at www.moplycleaning.com, you agree to these Terms.

1. Agreement to Terms

By accessing our website, booking our services, or using any of our cleaning services, you agree to be bound by these Terms, all applicable laws and regulations, and acknowledge that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using our website.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

2. Services We Provide

Moply Cleaning provides residential cleaning services throughout the greater Austin, Texas area including:

  • Standard Cleaning: Maintenance cleaning including surfaces, kitchens, bathrooms, and floors
  • Deep Cleaning: Comprehensive cleaning with attention to baseboards, fixtures, and detailed areas
  • Move-In/Move-Out Cleaning: Complete cleaning of empty properties including inside cabinets and appliances
  • Hourly Cleaning: Flexible cleaning services billed by the hour - perfect for custom projects, seasonal tasks, or ongoing maintenance on your schedule
  • Airbnb Cleaning: Turnover cleaning with bed remaking and restocking services
  • Commercial Cleaning: Available upon request for offices and small commercial spaces

Service Area

We provide services throughout the greater Austin, Texas metropolitan area including Austin, Round Rock, Cedar Park, Pflugerville, Georgetown, Leander, Lakeway, Bee Cave, Hutto, and other nearby communities. Service availability and travel fees may vary by location. Properties outside our standard service area may incur additional charges.

Independent Contractor Disclosure

Our cleaners operate as independent businesses (independent contractors), not employees of Moply Cleaning. Contractors choose their own methods, tools, and schedules within the service window you book. Moply coordinates bookings, conducts screening via a consumer reporting agency, and manages client support, quality review, and make-it-right remedies. Each contractor remains responsible for their own work quality, insurance, and legal compliance.

3. Booking and Scheduling

Booking Process

  • Services must be booked in advance through our website, phone, or approved booking platforms
  • All bookings are subject to availability and service area coverage
  • Bookings made within published availability windows are confirmed immediately; you’ll receive instant email/SMS confirmation with the arrival window and prep steps.
  • You must provide accurate and complete information when booking, including special requests, property conditions, and access instructions
  • Emergency, same-day, or next-day bookings may incur rush fees when available

Scheduling Changes

  • Changes to appointments must be made at least 48 hours in advance
  • Rescheduling less than 48 hours in advance will result in a fee of 25% of the booking subtotal
  • We reserve the right to reschedule due to weather, emergencies, or unforeseen circumstances with advance notice when possible

4. Pricing and Payment

Property Condition Requirements

You are responsible for providing accurate information about your property condition during booking. If upon arrival the property condition differs significantly from what was described (including but not limited to hoarding situations, excessive clutter, unsanitary conditions, biohazards, or scope of work substantially beyond what was booked), we reserve the right to:

  • Require a different service type at adjusted pricing before proceeding
  • Reschedule the appointment to allow for proper preparation and pricing
  • Decline service if conditions are unsafe or require specialized services beyond our scope
  • Charge the full service amount if the cleaner arrives and cannot proceed due to inaccurate property information provided by the customer

You will not receive a refund for inaccurate property information that prevents service completion.

  • All prices are estimates based on the information you provide during booking and are subject to final confirmation upon service completion
  • Final pricing may vary based on actual property conditions, size discrepancies, and time required beyond initial estimates
  • If property conditions or service requirements differ significantly from what was described during booking, pricing may be adjusted accordingly and discussed with you before proceeding
  • Additional services requested during cleaning will incur extra charges at current rates and are subject to contractor availability, time constraints, equipment availability, and contractor discretion
  • Travel fees may apply for locations outside our standard service area
  • We offer the following recurring service discounts:
    • Weekly cleanings: 20% discount
    • Bi-weekly cleanings: 15% discount
    • Monthly cleanings: 10% discount
  • All prices are subject to applicable Texas state and local taxes

Payment Terms

  • Payment is processed securely online through approved payment processors
  • We accept major credit and debit cards
  • The remaining total price (after deposit), including any taxes and fees, will be charged after the cleaning is complete
  • For recurring services, payment will be automatically processed using your stored payment method
  • Late payment fees of $100 or 7.5% per month (whichever is greater) may apply to overdue balances
  • Unpaid invoices exceeding 90 days may be sent to collections, and you will be responsible for all collection costs and reasonable attorney fees

5. Property Access and Security

Access Requirements

  • You must provide safe and reasonable access to all areas to be cleaned
  • If we cannot access your property due to your failure to provide access you will be charged 100% of the booking subtotal
  • You are responsible for securing valuables, fragile items, important documents, and personal belongings before our arrival
  • Pets must be secured, removed from cleaning areas, or properly restrained for cleaner safety
  • Properties must be reasonably safe for cleaning staff, with no hazardous conditions
  • You consent to cleaners taking before and after photos of cleaning areas for quality assurance purposes. These photos are required to maintain guarantee eligibility and are kept confidential

Keys and Access Codes

  • Access codes may be shared with cleaning contractors as needed to provide services
  • Physical keys must be retrieved immediately after each service unless alternative arrangements are made
  • You provide access information at your own risk and acknowledge the inherent security risks
  • We maintain confidentiality protocols but cannot guarantee against all security risks or breaches
  • We are not liable for security incidents related to access codes or key handling

Security Systems

If your property has a security alarm, please deactivate it on service day or provide detailed instructions and codes. Our team will attempt to reactivate the alarm upon departure following your instructions. We are not responsible for alarms triggered accidentally during cleaning or for security system malfunctions.

6. Our Responsibilities and Guarantees

Supplies and Equipment

  • Independent contractors bring their own professional tools, vacuums, mops, and cleaning products
  • Product and equipment choices are made by individual contractors
  • If you require specific products due to allergies or preferences, please provide them with clear instructions
  • We cannot guarantee specific brands, methods, or products as contractors operate independently

"Moply Make-it-Right Guarantee"

If an area included in your booked service was missed or cleaned inadequately, and we agree that the work did not meet reasonable standards:

  • Report issues within 24 hours of appointment completion
  • Provide specific details, notes, and photos to help us understand the concern
  • We'll schedule a re-clean within 3-5 business days at no extra charge if we determine the issue is valid
  • If you're still not satisfied after re-cleaning, contact us within 24 hours and we'll work to resolve the matter
  • This guarantee applies only to areas specifically included in your booked service type

What's Not Covered by Our Guarantee

Our guarantee does not cover:

  • Stains, odors, or damage requiring specialty restoration
  • Normal wear such as etched glass, permanently stained grout, or pre-existing damage
  • Additional services not requested and approved in advance
  • Biohazards, mold remediation, or pest infestations
  • Heavy construction debris or post-construction cleanup
  • Areas requiring moving heavy furniture, large appliances, or items over 25 pounds
  • Issues reported more than 24 hours after service completion
  • There is another service provider working on your home during our cleaning (i.e. electricians, carpenters, handymen, plumbers, painters, carpet cleaners, HVAC providers, etc.). We must be the only service provider at your home during our cleaning
  • You do not allow our cleaners to take before and after photos of your property. These photos are required for quality assurance and to validate guarantee claims
  • Personal preferences about cleaning methods when work meets reasonable standards

7. Limitations and Liability

Service Limitations

We do not clean or handle:

  • Biohazard materials (blood, bodily fluids, sewage, mold requiring remediation)
  • Pet waste and related biohazards (feces, urine, litter boxes requiring sanitation, vomit, soiled areas)
  • Active pest infestations requiring specialized treatment
  • Exterior windows above ground level or interior windows requiring tall ladders (over 3 steps)
  • Items requiring moving heavy furniture, large appliances, or objects over 25 pounds
  • Areas requiring special licenses, certifications, or professional restoration services
  • Hoarding situations requiring specialized training and equipment
  • Areas with structural damage or unsafe conditions

Safety Restrictions

For staff safety, contractors typically avoid:

  • Heavy lifting or standing on furniture, counters, or unstable surfaces
  • Handling of biohazardous materials or unknown substances
  • Using tall ladders (extension tools and step stools may be used when safe)
  • Working in areas with active electrical hazards, gas leaks, or structural damage

Liability Limits

  • Our total liability for any service-related claim is limited to the cost of the cleaning service provided
  • Independent contractors are responsible for their own actions, insurance, and liability
  • We are not responsible for the performance, actions, or omissions of independent contractors
  • We are not responsible for pre-existing damage, normal wear and tear, or damage caused by factors beyond our control
  • We are not liable for loss or damage to items not properly secured by customers or items left in cleaning areas without notice
  • Claims must be reported within 24 hours of discovery

8. Cancellation and Refund Policy

Your Cancellation Rights

  • Cancellations made less than 48 hours in advance will be charged 50% of the booking subtotal
  • Customer no-shows (when you cannot provide access at scheduled time without prior notice) are charged 100% of the booking subtotal

Our Cancellation Rights

We may cancel or reschedule due to:

  • Unsafe working conditions or hazardous property conditions
  • Weather-related issues - we'll contact you as soon as possible and offer you alternative appointment times
  • Cleaner emergencies (illness, family emergency, vehicle breakdown, etc.)
  • Other unforeseen circumstances beyond our reasonable control
  • We reserve the right to refuse service to anyone for legitimate business reasons

Refund Policy

  • Full refunds are available for services not yet performed when cancelled with proper notice (> 48 hour notice)
  • Once cleaning begins, labor hours worked in good faith are non-refundable, with refunds or credits available only for unperformed portions
  • We may offer re-cleaning service, partial refunds, or service credits to resolve quality issues at our discretion
  • Resolution options will not be provided for subjective dissatisfaction without allowing us reasonable opportunity to address legitimate concerns
  • Refunds, when approved, will be processed within 5-10 business days to the original payment method

9. Website Terms and Intellectual Property

Website License

Permission is granted to temporarily access our website for personal, non-commercial use only. You may not:

  • Modify, copy, reproduce, or redistribute website materials
  • Use materials for commercial purposes, public display, or resale
  • Attempt to reverse engineer any website software or functionality
  • Remove copyright, trademark, or other proprietary notices
  • Transfer materials to others or mirror on other servers without permission
  • Use automated systems to access or scrape website content

Intellectual Property

  • The Moply Cleaning name, logo, and branding are our exclusive property and may not be used without permission
  • All website content, features, functionality, and design elements remain our exclusive property or that of our licensors
  • Unauthorized use of our intellectual property is prohibited
  • Our website materials are protected by applicable copyright laws

  • Website materials are provided "as is" without warranties of any kind
  • We do not warrant accuracy, reliability, completeness, or currentness of website information, and information may change without notice
  • We may modify or remove website content at any time without notice
  • We are not responsible for technical errors, interruptions, data loss, or third-party website content

10. Privacy and Data Protection

We respect your privacy and maintain confidentiality about your property and personal information. Our Privacy Policy, available on our website and incorporated by reference, governs data collection, use, storage, and sharing. Key points include:

  • Personal information is collected only as necessary to provide services
  • Access codes and sensitive information are stored in password-protected systems, but may be transmitted via text message or other methods to contractors as needed for service delivery
  • Before and after photos are taken for quality assurance and may be used to validate service completion and guarantee claims. Photos are stored securely and not shared publicly
  • Information is not shared with third parties except as required by law or for service delivery
  • We comply with applicable Texas and federal privacy laws

By using our services, you acknowledge that internet and electronic transmissions are never completely secure or confidential.

11. Chargeback and Dispute Policy

Before initiating credit card chargebacks or disputes, you agree to:

  • Contact us directly via phone or email to resolve any service or billing issues
  • Allow us 48-72 hours to investigate and address concerns through our guarantee policy
  • Accept our offered resolution (re-cleaning, service credit, or partial refund as appropriate)
  • Participate in good faith efforts to resolve disputes before escalating

Initiating chargebacks or disputes without following this process:

  • Constitutes breach of our service agreement and may result in service termination
  • Voids eligibility for refunds, credits, future services, or guarantee benefits
  • Will be disputed with full supporting documentation, communications records, and evidence
  • May result in collections action for outstanding balances, chargeback fees, and reasonable attorney costs

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes, claims, or legal proceedings will be resolved in the appropriate state or federal courts in Texas, and you consent to the jurisdiction and venue of such courts.

Dispute Resolution Process

  • We strongly encourage direct communication to resolve issues before formal disputes
  • For disputes over $500, you agree to attempt mediation through a mutually agreed mediator before pursuing legal action
  • Legal action must be initiated within one (1) year of the cause of action arising or discovery of the claim
  • The prevailing party in legal proceedings is entitled to reasonable attorney fees, court costs, and other litigation expenses
  • Small claims court remains available for disputes within jurisdictional limits

Class Action Waiver

You agree that any disputes will be resolved on an individual basis only. You waive any right to participate in class actions, collective actions, or representative proceedings of any kind against Moply Cleaning.

Indemnification

You agree to indemnify, defend, and hold harmless Moply Cleaning, its officers, directors, employees, agents, contractors, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of our services or violation of these Terms
  • Your failure to provide accurate information or safe property conditions
  • Third-party claims related to property access you provided
  • Your negligent or intentional acts or omissions

Severability and Modification

If any provision of these Terms is found invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full effect. Invalid provisions will be replaced with valid provisions that best embody the original intent while remaining enforceable.

Force Majeure

Neither party will be liable for delays or failures in performance due to circumstances beyond reasonable control, including but not limited to natural disasters, government actions, pandemics, labor disputes, or other force majeure events. We will make reasonable efforts to notify you of such delays and reschedule services when possible.

13. Recurring Plan Discounts and Minimum Service Commitment

Plan Types and Discounts

Moply Cleaning offers three recurring plans with discounted pricing:

  • Weekly plan: 20% off our standard one-time price, with a minimum of 3 consecutive weekly cleanings
  • Bi-weekly plan: 15% off our standard one-time price, with a minimum of 3 consecutive bi-weekly cleanings
  • Monthly plan: 10% off our standard one-time price, with a minimum of 3 consecutive monthly cleanings

Nature of the Commitment

The minimum is not a fixed-term contract. It is a condition for receiving the discounted rate. You may cancel at any time. If you cancel before meeting the minimum, completed visits are re-rated as described below.

Early Cancellation and Re-rating

If you cancel your plan or fall out of cadence before completing 3 consecutive cleanings, Moply Cleaning will re-rate completed visits at our standard one-time price. We will charge only the difference between what you paid at the discounted rate and the standard one-time price for those visits. Example: if the standard rate is $160 and you paid $128 under a weekly plan, the adjustment is $32 for that visit.

Pauses and Skips

  • You may pause up to 2 weeks on a weekly plan and 1 appointment cycle on a bi-weekly or monthly plan with at least 48 hours' notice
  • Pauses within these limits do not affect your discount eligibility
  • Pauses beyond these limits or missed appointments without required notice may be treated as an early cancellation for purposes of discount eligibility

Quality Guarantee for Plan Customers

If you cancel due to quality concerns, notify us within 24 hours and provide pictures for quality concerns. We will provide a no-charge re-clean or, if you prefer, waive the discount difference for the affected visits. This quality guarantee is available once per household per year.

Billing Authorization

By enrolling in a recurring plan you authorize Moply Cleaning to keep a payment method on file, process payment after each service completion, and charge any applicable discount difference if you cancel before meeting the minimum. Charges will not exceed the standard one-time price for completed visits.

Ongoing Service

After you complete the minimum 3 cleanings, your plan continues at the discounted rate until you pause or cancel. You may cancel any time with at least 48 hours' notice before your next appointment without any re-rating of past visits.

14. Additional Terms for Specific Services

Recurring Services

  • Recurring services continue until cancelled by either party with proper notice
  • Payment methods must remain current and valid for automatic processing
  • Service frequency and pricing remain consistent unless modified by mutual agreement
  • Temporary service holds are available for vacations or extended absences with advance notice
  • Recurring services cancelled or rescheduled within 48 hours are liable for the same cancellation fees and reschedulign fees as all customers; grace may be given for first time cancellation or rescheduling for long-time customers

Airbnb and Rental Property Services

  • Turnovers must be scheduled with adequate time between guest departures and arrivals
  • Additional fees may apply for excessive property conditions or damages left by guests
  • Linen and restocking services available when supplies are provided by property owner
  • Last-minute cancellations may disrupt rental schedules and incur higher fees

Move-In/Move-Out Services

  • Properties should be empty of personal belongings for optimal cleaning
  • Additional time and fees apply if property is not vacant as expected
  • Utilities (water, electricity) must be active for service completion
  • Deep cleaning includes areas typically not accessed during regular occupancy

16. Acknowledgment and Entire Agreement

Important: These Terms constitute the entire agreement between you and Moply Cleaning regarding our services and supersede all prior agreements, representations, or understandings, whether written or oral.

By booking our services, using our website, or accepting cleaning services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these terms, please do not use our services.
